The initiative, backed by HOTREC and over 30 national hotel associations, is coordinated through the Dutch organization Stichting Hotel Claims Alliance. The lawsuit seeks compensation for financial losses that hotels claim resulted from Booking.com’s use of rate parity clauses—clauses that the European Court of Justice declared in violation of EU competition law in September 2024.
Hotels wishing to participate in the action have until August 29, 2025, to register. The case is expected to be filed with the Amsterdam District Court by the end of the year. The response so far has been strong, with high participation from hotels in Italy, Germany, the Netherlands, Greece, and Austria. On a relative scale, significant support has also come from Iceland, Liechtenstein, Luxembourg, Ireland, and the Netherlands.
The upcoming phase of the process involves consolidating and verifying data from participating hotels to prepare the official statement of claim. While HOTREC has not released further details on country-specific participation, the wide engagement highlights the importance of this legal effort for the European hospitality sector.
